TERMS AND CONDITIONS OF SALE

Article 1 – Identification of the seller

The Site www.atelierpoilu.com is published by Mrs Anastasia KOTAKI, sole trader operating under the trade name « Atelier Poilu », SIRET 98328291400024, whose registered office is at 6 rue Mathurin Régnier, 75015 Paris, France (hereinafter « the Operator » or « the Seller »). Contact: atelierpoilu@gmail.com.

Article 2 – Purpose and scope

These terms and conditions of sale govern, without restriction or reservation, all sales of dog accessory products concluded by the Operator with consumers and non-professionals (hereinafter « the Customer ») on the Site. They prevail over any other document. Placing an order constitutes full and unreserved acceptance of these terms.

The Operator reserves the right to amend these terms at any time; the applicable conditions are those in force on the date the order is placed.

Article 3 – Products

The Products offered are those appearing on the Site on the day it is consulted, while stocks last. Photographs and descriptions are as accurate as possible but cannot guarantee a perfect likeness, in particular as regards the colours rendered by the Customer's screen. Such variations do not engage the Operator's liability and do not constitute a lack of conformity.

The Products are accessories intended for pets. It is for the Customer to check that the size and intended use of the Product suit their animal, using the size guides provided on the product pages, and to supervise the animal's use of the Product.

Article 4 – Customer account

The Customer may create a personal account. The Customer is responsible for keeping their login details confidential and for all activity carried out from their account. All information provided must be accurate and up to date.

Article 5 – Orders

The Customer selects the Products, checks the details of the order and its total price, corrects any errors where applicable, then confirms the order and proceeds to payment. Confirmation constitutes acceptance of these terms and formation of the contract.

A confirmation email summarising the order is sent to the Customer. The Operator reserves the right to refuse or cancel any order on legitimate grounds, in particular in the event of a previous payment dispute, an abnormal order or suspected fraud.

Article 6 – Prices

Prices are stated in euros, excluding delivery costs. VAT not applicable, article 293 B of the French General Tax Code: the Operator falls under the basic VAT exemption scheme and therefore does not charge VAT. The price displayed is the net price payable.

The applicable delivery costs are indicated before the order is finally confirmed. Prices may be changed at any time; the applicable price is the one displayed on the day of the order.

Article 7 – Payment

Payment is due immediately upon ordering. The accepted means of payment are indicated on the Site. Transactions are secure; the Operator never has access to the Customer's full bank details, which are processed directly by the payment provider.

In the event of non-payment, partial payment or a payment incident, the Operator reserves the right to suspend or cancel the order.

Article 8 – Delivery

The Products are delivered to the address given by the Customer when ordering, in accordance with the terms and geographical zones described in the Shipping Policy.

In accordance with article L.216-1 of the French Consumer Code, the Operator undertakes to deliver the Products within a maximum of thirty (30) days from the conclusion of the contract. In the event of delay, the Customer may, after instructing the Operator to deliver within a reasonable additional period, terminate the contract by registered letter or in writing on another durable medium; all sums paid are then refunded no later than fourteen (14) days after termination.

Article 9 – Transfer of ownership and of risk

Ownership transfers upon full payment of the price. In accordance with article L.216-4 of the French Consumer Code, the risk of loss or damage transfers when the Product is physically handed over to the Customer or to a third party designated by them, other than the carrier proposed by the Operator.

Article 10 – Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the Product to exercise their right of withdrawal, without having to give reasons or incur any penalty.

To exercise it, the Customer notifies their decision by an unambiguous statement, by email to atelierpoilu@gmail.com or by post, stating their name, address and order number. The Customer may use the model withdrawal form reproduced at the end of these terms, without obligation. An acknowledgement of receipt is sent to them.

The Customer then has fourteen (14) days from notification to return the Product. Return costs are borne by the Customer, except where the Product is defective, damaged or does not match the order, in which case they are borne by the Operator.

The Operator refunds all sums paid, including the initial standard delivery costs, no later than fourteen (14) days after the date on which it is informed of the decision to withdraw. It may defer the refund until the Product has been recovered or until the Customer has provided proof of dispatch, whichever occurs first. The refund is made using the same means of payment as that used for the order, unless expressly agreed otherwise.

The Customer may be held liable for any depreciation of the Product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.

Article 11 – Exceptions to the right of withdrawal

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised, in particular, for Products made to the Customer's specifications or clearly personalised, Products liable to deteriorate or expire rapidly, Products unsealed after delivery which cannot be returned for hygiene or health protection reasons, and Products which, after delivery, are inseparably mixed with other items.

Article 12 – Legal guarantee of conformity

The Operator is bound by the legal guarantee of conformity provided for in articles L.217-3 et seq. of the French Consumer Code. The Customer has two (2) years from delivery of the Product to bring a claim.

In the event of a lack of conformity, the Customer may choose between repair and replacement of the Product, subject to the cost conditions set out in article L.217-12. The Customer is exempt from proving the existence of the lack of conformity during the twenty-four (24) months following delivery of the Product.

If repair and replacement are impossible, the Customer may obtain a price reduction or termination of the sale under the conditions of articles L.217-14 et seq. The legal guarantee of conformity applies independently of any commercial warranty that may be granted.

Article 13 – Guarantee against hidden defects

The Customer may also rely on the guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code, for two (2) years from discovery of the defect. The Customer may then choose between termination of the sale and a price reduction, in accordance with article 1644 of the French Civil Code.

Article 14 – Liability

The Operator is automatically liable for the proper performance of the contract under the conditions of article L.221-15 of the French Consumer Code. It may be relieved of all or part of its liability by proving that the failure to perform is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to a case of force majeure.

As the Products are intended for animals, the Operator cannot be held liable for damage resulting from use other than as intended, from an unsuitable choice of size despite the guides provided, or from a failure to supervise the animal.

Article 15 – Force majeure

Neither party may be held liable for a failure to perform its obligations resulting from a case of force majeure within the meaning of article 1218 of the French Civil Code.

Article 16 – Personal data

Personal data collected is processed in accordance with the Privacy Policy available on the Site, in compliance with Regulation (EU) 2016/679 (GDPR) and French law no. 78-17 of 6 January 1978 as amended. The Customer has rights of access, rectification, erasure, restriction, objection and portability, which may be exercised at atelierpoilu@gmail.com, as well as the right to lodge a complaint with the CNIL (www.cnil.fr).

Article 17 – Complaints and consumer mediation

Any complaint may be sent to atelierpoilu@gmail.com. The Operator endeavours to respond as quickly as possible.

In accordance with article L.612-1 of the French Consumer Code, the Customer has the right to use a consumer ombudsman free of charge with a view to the amicable resolution of a dispute with the Operator, provided they have first attempted to resolve it by a direct written complaint.

Article 18 – Governing law and jurisdiction

These terms are governed by French law. In the event of a dispute, and failing amicable resolution or successful mediation, the French courts shall have jurisdiction under ordinary law. A consumer Customer may bring proceedings either before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.

Article 19 – Partial invalidity

If any provision of these terms is declared void or unenforceable, the remaining provisions shall retain their full force and effect.
